On November 17, 2020, the United States Patent and Trademark Office (USPTO) announced new trademark fees for 2021. These fee increases become effective January 2, 2021. The fee increases are listed below.
New Application Filing Fees and Prosecution Fees
TEAS Plus application
- Increase from $225 per class to $250 per class
TEAS Standard application
- Increase from $275 per class to $350 per class
Filing an application under 66(a)
- Increase from $400 per class to $500 per class
Post Registration Fees
Filing a Section 8 or Section 71 Affidavit
- Increase from $125 per class to $225 per class
Filing a Section 7 Request before the submission of a Section 8 or Section 71 affidavit and which only deletes good, services, and/or classes
- $0
Deletion of goods, services, and/or classes in a Section 7 Request, Response to Office Action, or a voluntary amendment filed after submission and prior to acceptance of a Section 8 or Section 71 affidavit
- $250 per class
Petition Fees
Petition to the Director
- Increase from $100 to $250
Petition to Revive
- Increase from $100 to $150
Letter of Protest
- $50
Trademark Trial and Appeal Board (TTAB) Fees
Filing of a Petition to Cancel or Notice of Opposition
- Increase from $400 per class to $600 per class
Requests for an extension of time to oppose
- Initial 30-day extension: $0
- Initial 90-day extension or subsequent 60-day extension: Increase from $100 to $200
- Final 60-day extension: Increase from $200 to $400
The USPTO may refund $200 if
1) the petition to cancel is based solely on abandonment or nonuse,
2) default judgment is entered with no appearance by the defendant, and
3) no filings other than the petition to cancel are made
Filing the Notice of Appeal
- Increase from $200 to $225 per class
Filing an Appeal Brief
- $200 per class
Requests for extension of time to file an appeal brief
- First request: $0
- Second and subsequent requests: $100 per application
Request for an Oral Hearing
- $500 per proceeding
