J. Warren Lytle, Jr.

Jay is a partner in the Washington, D.C. Office of Sughrue Mion PLLC. Jay practices in all areas of patent law with an emphasis on managing prosecution of large patent portfolios, inter partes patent matters including patent litigation in federal courts and patent trials in the U.S. Patent and Trademark Office (PTO), counseling clients on intellectual property matters, preparing and prosecuting patents, and opinion work. Jay has experience litigating patent issues in various U.S. district courts and with contested patent proceedings before administrative agencies, including the International Trade Commission (ITC), and as lead counsel in patent trials before the PTO's Patent Trial and Appeal Board (PTAB). He also has considerable experience writing and prosecuting patent applications in the electrical and mechanical arts, particularly with computer hardware, software, network, semiconductor and telecommunications technologies. In his practice he advises clients on establishing, building and maintaining U.S. and foreign patent portfolios, analyzing patent portfolios and licensing patents.

Jay has represented clients for over two decades before the USPTO including serving as lead counsel in PTAB trials, with an emphasis in software, computer and electronics technologies. In addition to his practice before the USPTO, Jay is experienced in patent litigation before the federal courts. Prior to becoming an attorney, he worked as an electrical engineer and programmer for IBM Corporation on large technically complex projects and products. Jay draws on this breadth of experience to counsel clients on all types of intellectual property matters and to help clients acquire, enforce, and defend against intellectual property rights.

Jay is an adjunct associate professor at American University's Washington College of Law in Washington, D.C., where he teaches a course on patent prosecution. Jay also is a co-author of The Essential Case Law Guide to PTAB Trials (2018), published by the ABA Section of Intellectual Property Law.
